These Terms and Conditions govern tree care services provided by Benjamin's Tree Service in Las Vegas, Nevada. By accepting an estimate, scheduling service, or allowing work to begin, you agree to these terms.

Scope of Service and Limitations

Services are limited to the work described in the written estimate. Any additional labor, hauling, stump work, debris disposal, permit-related activity, or emergency response not listed in the estimate may require a revised quote and separate approval.

Estimates, Payment Terms, and Fees

Pricing is based on site conditions visible at the time of estimate. If hidden hazards, access restrictions, or unexpected structural issues are discovered, scope and pricing may be updated before completion. Payment is due according to the invoice terms provided to the customer. Past-due balances may be subject to service hold and collection efforts as allowed by law.

Cancellations and Rescheduling

Customers may request cancellation or rescheduling by contacting us as early as possible. Cancellations after crew dispatch, on-site arrival, or equipment mobilization may incur a reasonable service charge based on time and resources committed.

Weather and Safety Conditions

Work may be delayed, paused, or rescheduled when weather, wind, lightning, ground saturation, utility conflicts, or other safety risks make service unsafe. We reserve the right to stop work immediately to protect people, property, and crew safety.

Liability and Disclaimers

While we use industry-standard care and trained crews, tree and landscape work carries inherent risks. We are not responsible for pre-existing defects, concealed decay, underground utilities not marked by the property owner or utility locator, or damage caused by events beyond our control. To the fullest extent permitted by law, liability is limited to the amount paid for the specific service giving rise to a claim.

Governing Law

These Terms are governed by the laws of the State of Nevada. Any dispute related to services provided under these Terms will be resolved in the appropriate state or federal courts located in Clark County, Nevada.
